The Illegal Gambling Under Bob Riley’s Nose

If Bob Riley and John Tyson are serious about shutting down all illegal gambling in Alabama, they won’t have to look very far.  All they need to do is walk across Union Street to the Folsom Administrative Building.  Former Gaming Task Force Commander David Barber isn’t the only Riley Appointee who seems to have a gambling problem.

When I worked for the Department of Conservation and Natural Resources my co-workers played football boards and Commissioner Barnett Lawley, a Riley appointee, was a frequent player and always had enough cash to buy several spaces on the football board.  He’s a huge Auburn fan.  So much so that when the Auburn Board of Trustees went behind the back of former Head Coach Tommy Tuberville, Commissioner Lawley took an extended leave of absence from the Conservation Department in 2003 to go over to Auburn University and set things straight; leaving the department in the hands of Richard Liles, a holdover from the Siegelman Administration who really ran the department anyway because Commissioner Lawley, an oilman by trade, never had much credibility with the dominant environmentalist clique at Conservation.

Subleases Masquerading As Assignments

The operative phrase is “entire interest” and whether or not this refers to the time left on the lease or the percent acreage. You can have a legal assignment of 100% of the acreage, but there must not be any time remaining on the lease term which will revert back to the assignor, otherwise what you’ve really got on your hands is a sublease of 100% of the parcel.

What is an assignment of a lease?

An assignment occurs when a tenant transfers away the entire remainder of his lease, in terms of duration.

Real property rights can be assigned just as any other contractual right. However, special duties and liabilities attach to transfers of lease interests. With an assignment, the assignor transfers the complete remainder of the lease term to the assignee. The assignor must not retain any sort of reversionary interest in the right to possess. If any portion of the original lease term is reserved by a tenant assignor, then the act is not an assignment, but instead is a sublease. Read the story »
